Welcome to NOITE! These Terms of Use ("Terms") govern your access to and use of the NOITE mobile application and related services (the "Service"). By using NOITE, you agree to these Terms and to our Privacy Policy.

1. Eligibility

• To use NOITE, you must be at least 18 years old in Latin America and Europe, or 21 in the United States. You are also required to maintain a truthful profile, using your first name and a clear photo of your face. Usernames that don't follow this rule are not allowed. If your account was previously suspended or deleted, you may not create a new one.
   

2. The NOITE Service

• NOITE helps you understand what's happening at bars through information sent by other users who are already there. Reports include crowd level, predominant gender, approximate average age, subjective attractiveness, music style, and whether there’s a line. 
   

• These impressions are human and subjective, so they may vary. We rely on users with a strong history of good contributions to maintain content quality, but we cannot guarantee full accuracy. NOITE may remove or reject reports that are false, repetitive, or break the rules.
   

3. Coins

• Coins are the app’s virtual currency. You can earn them by taking specific actions, like reporting the crowd at a bar — as long as certain conditions are met:
  - Be physically near the bar at the time of the Report
  - Respect a minimum time interval between Reports at the same venue
  - Follow the usage rules and code of conduct

• Reward logic may vary depending on testing, user behavior, or time of day.

• Important: Coins cannot be exchanged for money or used in bars. They only exist within NOITE. Misuse — like faking your location or spamming Reports — may lead to account suspension and forfeiture of earned Coins.
   

4. Kudos

• See someone interesting at a bar? Send them a Kudos. You can delete a Kudos you've sent or received at any time.

• When a Kudos is replied to, a Conversation automatically starts. Either party can end it at any time.
   

5. Account and Profile​

• You are responsible for keeping your login information confidential. All activity performed under your account will be considered your responsibility.

• You can edit your profile, update preferences, or deactivate/delete your account at any time from within the app settings.
   

6. Places in the App

• Bars shown in NOITE are curated by our team. We select the best spots in each city. This list may be updated or modified at any time to ensure the best experience possible.
   

7. Location Usage

• NOITE only accesses your location when the app is open. Your location is used to calculate distance between you, bars, and other users, in order to personalize your experience. We do not track your location in the background or when the app is closed.
   

8. Rules of Use and Conduct

The following are not allowed:

• Using bots, scripts, or automation

• Falsifying location or spamming Reports

• Using NOITE for commercial purposes without authorization

• Harassing, insulting, or impersonating other people

• Use the app on more than one device simultaneously

• Using NOITE for illegal, abusive, or fraudulent activities, or anything that harms user experience, is strictly prohibited. Accounts that break these rules may be suspended or deleted without notice.
   

9. External Links

• Bar profiles may include links to Instagram, Google Maps, Uber, WhatsApp, Google Reviews, or reservation websites. These links are provided for your convenience, but NOITE is not responsible for errors, failures, or changes in these third-party services.
   

10. Privacy

• Your privacy is a priority. Read our Privacy Policy to understand how we handle your data.
   

11. Limitation of Liability

• NOITE is provided “as is” and “as available,” without guarantees of continuous operation, accuracy, or suitability for any particular purpose. We are not responsible for technical issues, interruptions, or decisions made based on information submitted by other users.
   

12. Indemnification

• You agree to hold NOITE, its partners, and team harmless from any liability, damages, losses, or costs resulting from misuse of the platform or violation of these Terms.
   

13. Updates to These Terms

• We may update these Terms at any time. If we do, we’ll notify you via the app or by email. Continuing to use NOITE after changes means you accept the new Terms.
